A proposed settlement of a lawsuit challenging the tracking of mobile-phone users could make it easier for users to opt out of targeted ads on some mobile websites.
Ringleader Digital Inc., a New York company that places ads on mobile phones, said it had agreed to settle claims that it improperly tracked phone users by placing the equivalent of “cookies” on their phones. The suit, filed in September in U.S. District Court in Los Angeles, claimed that Ringleader’s technology “re-spawned” the cookies when users tried to delete them.
Under the proposed settlement, Ringleader will place a link where its cookies are stored on a phone that will allow users to opt out of receiving targeted ads on mobile websites. (On an iPhone, it is the “databases” setting under the Safari browser.) Users would still see ads, but they won’t be targeted based on a user’s Web browsing behavior. The case did not address ads that appear inside applications on mobile phones.
“The one thing we’ve learned is that enhanced transparency is the key to consumer privacy,” said Ringleader Chief Executive Bob Walczak. “We want to make sure consumers know they have the ability to opt out.”
Majed Nachawati, one of the lawyers who filed the suit, said the proposed settlement includes a monetary payment by Ringleader. But he said he could not immediately recall the amount of money or to whom it would be paid. Mr. Walczak declined to comment on the financial terms.
“Ringleader has been very cooperative about responding to privacy concerns while protecting their ability to remain in business,” Mr. Nachawati said.
Washington, Jan 22 (ANI): Don’t have the willpower to decline calls or texts when you’re driving? Well, a German telecom company has come up with an application that does it for you.
“We heard loud and clear from our customers that distracted driving is an issue they care deeply about. They want to help themselves drive responsibly, and they want to make sure their kids are doing the same,” ABC News quoted Torrie Dorrell, T-Mobile USA’s vice president of applications, content and games, as saying.
The 4.99 dollars per month application, developed by Emeryville, Calif.-company Location Labs, will be available to T-Mobile customers with Android smartphones.
When activated, the DriveSmart application determines how quickly a phone is switching between cell phone towers. When it senses that the phone is moving faster than 10 mph, within a few minutes, it automatically sends phone calls to voicemail or a hands-free Bluetooth headset (depending on which version the customer selects). It sends text messages to a user’s inbox.
Depending on the phone, the application can also disable audible alerts so that the driver isn’t even aware of incoming messages.
If drivers want to override the service for an emergency call or if users want to override the feature while they’re in the passenger seat (or even on a moving bus), DriveSmart allows that.
Location Labs’ CEO Tasso Roumeliotis said the application would initially only be available on newer T-Mobile Android phones. But considering that the response to the service has been “exceptional,” they hope to reach other platforms. (ANI)
Leaders of a Wisconsin Rapids-based wireless telephone service provider say they are working around the clock to resolve issues that resulted from a network upgrade during the weekend.
In an effort to accommodate what Element Mobile calls “a very small group” of people who have experienced service-related issues, the company announced Wednesday it will offer to credit those customers’ accounts.
“We have a process in place that compensates those with issues or whose service has been disrupted,” said Dan Kowalke, the company’s marketing manager. “We are working nonstop to provide resolution to issues being reported.”
Any customer experiencing service-related issues because of the network upgrade is eligible for the credit and may fill out a form online at www.

Since the company began upgrading its network Saturday, customers have reported a variety of issues, including spotty reception and unreliable text messages, which were not delivered until hours later. Others were unable to access the Internet or
e-mail, and some said their phones stopped working altogether.
For Rome resident Wayne Hall, the upgrades initially meant he was unable to use the Motorola Milestone he purchased from his local Alltel store in November.
“They don’t offer service at all, and I’m not very pleased,” he said Friday during an interview with the Daily Tribune.
After sending an e-mail Saturday to two company leaders, including Chief Operating Officer Jerry Wilke, Hall met with customer service officials Tuesday evening. He said officials explained their situation and worked to fix Hall’s phone. He continues to work with company leaders to resolve such issues for a small number of fellow customers.
“We let our emotions run rampant,” Hall said. “I’m now giving them a fair chance.”
However, many customers were not as forgiving, saying they want answers from the company.
Optus will introduce two-year warranties for Apple’s iPhone on post-paid contracts of the same length, with competitors set to follow in order to comply with changes to Australian consumer legislation.
The SingTel subsidiary became the last major Australian telco to offer two-year warranties for mobile phones following an Australian Competition and Consumer Commission (ACCC) investigation into the matter in 2009.
Vodafone Hutchison Australia (VHA), which was subject to the initial investigations, changed its warranties in January last year, with Telstra following suit in October.
However, in both cases the extended warranties excluded Apple’s iPhone, which continued to have a 12-month warranty.
Introduction of Australian Consumer Law, which came into effect on 1 January 2011, allowed the ACCC to push for the inclusion of the iPhone in the set of phones covered under a warranty lasting the life of the contract.
Under the court enforceable undertakings lodged by Optus this week, the telco has agreed to provide an express repair warranty for mobile phones for the life of the contract and replace the unit within its ‘early life failure’ period, or 30 days for most manufacturers.
The telco will also review its trade practices compliance program as part of the undertaking.
Outgoing ACCC chairman, Graeme Samuel, told Computerworld Australia that Telstra and VHA would breach the new consumer legislation if they failed to provide full warranties for Apple’s iPhone, regardless of previous contracts with the industry watchdog.
“It’s not a question of having to seek it from them because in my view the law says that now quite clearly,” he said. “Whether there’s an undertaking there, the law applies in any event.”
A Telstra spokesperson said the telco would “comply with its legal obligations regarding handset warranties on iPhones, as with any other brands”.
VHA was contacted for comment but did not respond at time of writing.
It remains unclear as to how warranties will be affected beyond the global 12-month guarantee Apple currently offers for the iPhone. An Apple spokesperson refused to comment on the matter, only indicating that it was a matter of the telco’s business practices rather than the manufacturer.
Samuel said the ACCC wasn’t concerned with how the warranties were provided and confirmed the watchdog had no negotiations with the computing giant as part of the undertaking. He suggested that bulk purchase of extended warranties from Apple or establishment of in-house repair centres could be used to satisfy legal concern.
“Frankly, my view has always been that if you sold an iPhone under a 24-month contract, you have to repair if you’re the retailer,” he said.
